MTN Fined 15m For Unlawful Airtime Deduction by the Appeal Court

MTN Communication Limited faced a court hearing on Tuesday in Abuja for unlawfully deducting subscriber’s airtime through unsolicited service.

In the court sitting, 15 million naira for such act as the ‘three member of justice’ hearing said such act is fraud.

In the case, the appeal court said the constant act of deducting subscribers’ airtime by the network providers for auto-renewal of services and subscription which they did not subscribe to, is a fraudulent act.

Also, the court stated that the constant sending of messages to subscribers without their permission resulted to a breach of subscribers’ privacy. The court said this is a violation of regulation 28 of consumer code of practice regulations.

The stated act of customer’s privacy breach can be found in the section 37 of the 1999 amended constitution and it’s a crime.

However, among the many angry customers of the MTN network providers, one Mr Ezugwu Anene took the case to the court.

The case’s appeal was marked: CA/ABJ/CV/137/2022.

Furthermore, Mr Anene filed this case stating that a total amount of N20 which he did not solicit for and a total of 244 messages.

When he was asked, he said that he went to the Abuja headquarters to complain but nothing was done about it which led to his decision to take the matter to court.

Interestingly, the court’s decision gladdened the heart of many subscribers who said Mr Ezugwu Anene spoke their mind and represented them well.
